Surrogacy Law in Georgia
Eligibility: In Georgia, surrogacy is legal for married heterosexual couples or for heterosexual couples who have lived together for at least one year and can provide proof of cohabitation. This makes Georgia a legally safe destination for surrogacy for intended parents of any nationality.
Birth Certificate: Under Georgian surrogacy law, the intended mother and father are recognized as the sole legal parents from the moment of the child’s birth. The surrogate has no parental rights, and her name does not appear on the birth certificate. The child is registered in the intended parents’ names within a few working days after birth.

If Embryo was Created with a Donor Gamete
If your embryo was created using either a donor egg or donor sperm, it’s important to know that, under Georgian surrogacy law, the donor must be identifiable. This means the donor must either sign the notarized surrogacy contract in person or be represented by someone holding a notarized Power of Attorney (POA).

Can I ship frozen embryos, oocytes, or sperm to Georgia, and what documents do I need?
Yes, shipment is possible. For surrogacy, specific documentation is required for each type of frozen material before shipment, which is later used for baby registration to obtain the birth certificate. This typically includes a marriage certificate, Power of Attorney, embryo authenticity report, embryo creation report, and blood tests for infectious diseases from both parents. For transfers to the intended parent only (not surrogacy), clinic medical reports alone are sufficient.
May I use embryos created with donor egg or sperm for surrogacy in Georgia?
It depends on whether the donor was known or anonymous. Embryos created using anonymous donors cannot be used for surrogacy. If a known donor was used, you’ll need a passport copy, Power of Attorney, and clinic confirmation of the donor’s status — with these documents, the embryos can be considered for transfer to a surrogate.
If my embryos had PGS testing, can I transfer ones that were abnormal or showed high mosaicism?
No. We only accept embryos that have passed PGS screening and are either euploid, show “No Interpretation” results, or show low mosaicism. Abnormal embryos are not approved due to low success rates and associated health risks.
Is shipping frozen materials to Georgia safe?
Yes. We work with hand-carry shipping companies that collect and deliver materials directly to the clinic, managing all customs and airport procedures to prevent X-ray exposure. These companies use specialized containers that safely maintain materials for 5–7 days, even in the event of delays, with journey history recorders tracking nitrogen levels throughout transit — reviewed by our medical team upon arrival. In our experience, we have never received damaged materials.
Can I ship frozen materials out of Georgia?
Yes. According to Georgian regulations, frozen materials can be shipped out of the country.
